1. Welcome to Tomodachi

Tomodachi Social Community App ("Tomodachi," "we," "our," or "us") is a social community platform operated by A-Tech I.T. Solutions that enables users to connect, share content, participate in activities, engage with creators, and discover participating businesses.

These Terms govern use of Tomodachi and associated features.

By creating an account or using the app, you agree to these Terms, the Privacy Policy, Community Guidelines, and applicable feature-specific policies. If you do not agree, do not use the service.

2. Age Requirement

Tomodachi is intended for individuals aged eighteen (18) years or older. By registering, users confirm they meet this minimum age.

Accounts belonging to persons under 18 may be restricted or removed.

3. User Accounts

Users must provide accurate registration information, protect login credentials, and take responsibility for account activities.

False identities, impersonation, and duplicate accounts created to manipulate rewards or platform functions are prohibited.

Account deletion is available through the app or designated website process and is governed by the Privacy Policy.

4. Identity Verification

Tomodachi may require a government-issued ID, selfie, or other reasonably necessary information to verify identity and prevent impersonation, fraud, and abuse.

Verification may be required for reward redemption, eligible bookings, marketplace transactions, and future accommodation services.

Verification information is handled under the Privacy Policy. False or misleading documents are prohibited.

5. Posting Content

Users may upload permitted photos, videos, text, comments, and other content.

Users retain ownership of their original content and grant Tomodachi a non-exclusive, worldwide, royalty-free license to host, process, reproduce, display, and distribute uploaded content as reasonably necessary to operate and promote platform features, subject to applicable law and privacy settings.

Users must hold required rights and permissions.

Tomodachi may remove content that violates law or platform policies.

6. Music, Copyright, and User-Uploaded Content

Tomodachi provides original music within the application for authorized use by users in photo and video posts, subject to applicable rights and usage restrictions.

Users may also upload their own photos and videos, including videos with background music or audio.

Users are responsible for ensuring they have the necessary rights, licenses, or permissions for all copyrighted material included in their uploads.

Tomodachi prohibits unauthorized distribution of copyrighted content.

Copyright owners or authorized representatives may report suspected infringement by emailing atechitsolutions@tomodachi.ph or messaging Team Tomodachi inside the app.

Reports should identify the work, the reported content and its location, the complainant's contact details, and the complainant's authority to act.

Tomodachi will review reports and remove or restrict content when appropriate.

Repeated or serious infringement may result in restrictions or termination.

Tomodachi will cooperate with valid lawful requests.

7. Community Rules

Users must treat others respectfully.

Harassment, threats, discrimination, scams, impersonation, illegal content, unauthorized disclosure of personal information, and manipulation of app systems are prohibited.

Users must follow the Community Guidelines.

Tomodachi may investigate reports and take proportionate measures such as content removal, restrictions, suspension, or termination.

8. TomoCoins and TomoPoints

TomoCoins (TC)

TomoCoins are digital credits obtained through authorized in-app purchase mechanisms, including the Apple App Store and Google Play Store.

They may be used to:

TomoCoins are not cash and are not used to pay for restaurant meals, accommodation, or physical merchandise.

Purchased TomoCoins cannot be directly redeemed for cash or GCash vouchers.

Purchases and refunds are subject to the applicable app-store terms and law.

TomoPoints (TP)

Eligible users earn TomoPoints through qualifying activities, including creator engagement, approved partner activities, and promotions.

TomoPoints cannot be directly purchased.

The current redemption rate is 5,000 TP for a ₱250 GCash voucher, subject to the Redemption Policy and eligibility checks.

Only points required for an approved redemption are deducted.

For example, if a user holds 5,100 TP and redeems 5,000 TP, 100 TP remain.

Further limits, verification, reward availability, and anti-fraud measures are explained in the Redemption Policy.

TomoPoints cannot be sold or transferred between users unless a published program explicitly permits it.

Fraudulently generated points may be held or reversed following appropriate review.

Earning points does not establish an employment relationship.

9. Private Content and Digital Unlocks

Users may share locked images within messages.

Applicable TomoCoin costs should be shown before users confirm a purchase.

Completed unlocks consume the displayed credits, subject to applicable app-store refund rights and law.

Users may not distribute private material without permission or upload prohibited content.

10. Affiliated Restaurants and Partner Establishments

TomoHub enables eligible users to discover restaurants, request reservations, access supported walk-in and takeaway functions, and contact partners.

Restaurants determine menus, prices, availability, operating hours, and service conditions.

Customers pay restaurants directly for food and related services unless a separately disclosed arrangement applies.

Tomodachi may receive fees or commissions from partner establishments under separate agreements.

TomoCoins are not payment for restaurant meals or bookings.

Eligible verified transactions may earn TomoPoints under the Redemption Policy.

Tomodachi facilitates services but cannot guarantee independent partner availability or quality, without excluding non-excludable legal responsibilities.

11. Nightlife Experiences

Tomodachi may feature participating bars, lounges, and entertainment venues.

Users must follow venue policies and applicable age and safety laws.

Participating establishments remain responsible for their independent operations.

12. Storemadachi Marketplace and TomoStay

Tomodachi may introduce or expand Storemadachi marketplace and TomoStay accommodation services.

Availability depends on region, eligibility, technical rollout, and partnerships.

Users and partners must provide accurate prices, descriptions, and availability.

Additional verification and feature-specific terms may apply.

Sellers and accommodation operators are responsible for their own fulfillment, subject to Tomodachi's obligations under applicable law.

13. User Safety, Live Streaming, and TomoConnect

Tomodachi offers reporting and blocking tools to help users manage unwanted interactions.

Users may report objectionable users, posts, live activity, or other misconduct using the available functions or support channels.

Users can block others.

Tomodachi may review reports, monitor or review live activity and flagged conduct, and take proportionate action including removal, restrictions, suspension, or termination.

Harassment, threats, impersonation, scams, exploitation, illegal acts, and unauthorized recording or sharing of private communications are prohibited.

These rules apply to messaging, livestreams, and TomoConnect where available.

Moderation is conducted in accordance with the Privacy Policy and applicable law.

14. Intellectual Property

Tomodachi's software, branding, mascots, interface designs, logos, and proprietary technology belong to A-Tech I.T. Solutions or their licensors.

Unauthorized reproduction, distribution, reverse engineering, or commercial exploitation is prohibited except where law allows.

User-created content is addressed in Section 5.

15. Platform Changes

Tomodachi may introduce, modify, suspend, or discontinue functions for operational, technical, security, or legal reasons.

Material changes affecting purchased digital products or user rights will be communicated where required by law.

16. Limitation of Liability

Services are supplied subject to applicable law.

To the extent legally permitted, A-Tech I.T. Solutions is not responsible for losses caused solely by independent user behavior, unrelated third-party operations, or circumstances outside its reasonable control.

Nothing here excludes legal obligations, statutory consumer rights, or liability that cannot lawfully be excluded.

17. Account Suspension and Termination

Tomodachi may restrict, suspend, or terminate accounts for violations, fraud, identity abuse, prohibited content, or threats to safety.

Where appropriate, users may receive notice or an opportunity to appeal.

Immediate action may be taken when reasonably necessary to prevent harm, fraud, or legal violations.

Users may request account deletion according to the Privacy Policy.

18. Updates to These Terms

Tomodachi may revise the Terms for legal, security, or service changes.

Material changes will be communicated when required.

Continued use after valid notice and effectiveness may count as acceptance where legally permitted; additional consent will be requested when required.

19. Governing Law

These Terms are governed by the laws of the Republic of the Philippines without limiting mandatory consumer or privacy rights applicable in other jurisdictions.

Disputes are subject to courts having proper jurisdiction under applicable law.
