1. Introduction

This End-User License Agreement ("Agreement") is a legal agreement between you (“User”) and A-Tech I.T. Solutions(“Company”, “we”, “our”, or “us”) governing your access to and use of the Tomodachi Social Community App (“App”).

Tomodachi is a social community platform that allows users to post content, interact with other members, participate in events, discover venues, and access digital services.

By downloading, installing, creating an account, or using Tomodachi, you agree to be bound by this Agreement and our policies. If you do not agree, you must discontinue use of the App.

Users must be at least 18 years old to use Tomodachi.

2. License Grant

Subject to your compliance with this Agreement, A-Tech I.T. Solutions grants you a limited, non-exclusive, non-transferable, revocable license to use the Tomodachi app on a device you own or control.

You may not:

• Reverse engineer, decompile, or disassemble the app
• Modify, copy, or create derivative works
• Use the app for commercial redistribution or resale
• Attempt to bypass security or platform protections

Violation of these restrictions may result in termination of your account.

3. Intellectual Property

All intellectual property related to Tomodachi — including:

• Software and source code
• Platform design and interface
• Logos, graphics, and branding
• Mascots and visual elements
• Platform features and technology

remain the exclusive property of A-Tech I.T. Solutions.

Unauthorized reproduction or use is strictly prohibited.

4. User Accounts

To access Tomodachi services, users must create an account.

Users agree to:

• Provide accurate and truthful information
• Maintain the confidentiality of their account credentials
• Sending virtual gifts
• Be responsible for activity under their account

Tomodachi reserves the right to suspend or remove accounts involved in fraud, abuse, or violations of this Agreement.

5. In-App Purchases & Virtual Currency

Tomodachi uses two types of virtual currency.

TomoCoins (TC) — Paid Currency

TomoCoins are purchased within the app and may be used for premium features including:

• Sending likes on posts
• Unlocking private images or videos
• Sending virtual gifts during livestreams
• Viewing profile insights or engagement features
• Accessing other premium features within the platform

TomoCoin Pricing Tiers

• ₱25=100TC
• ₱60=250TC
• ₱120 = 500 TC
• ₱240 = 1,000 TC
• ₱360 = 1,500 TC
• ₱680 = 5,000 TC

All purchases are processed through the Apple App Store or Google Play Store.

TomoCoins:

• Are non-transferable
• Have no real-world monetary value
• Are non-refundable except where required by law

TomoPoints (TP) — Earned Currency

TomoPoints are earned through engagement and activity within the platform.

Users may earn TP through:

• Post engagement (likes)
• Monthly rankings and leaderboards
• Livestream engagement
• Confirmed partner venue bookings
• Other reward activities within the app

Redemption Rate

5,000 TP = ■250

This redemption rate is fixed.

TP may be redeemed for rewards such as:

• Food vouchers
• Mobile load
• GCash or Maya redemption
• Streaming subscriptions
• Grocery gift cards
• Digital platform rewards

TomoPoints cannot be sold, traded, or transferred between users.

6. Restaurant & Hotel Booking Services

Tomodachi may allow users to discover and book partner restaurants or hotels.

Payments may be made through:

• Direct venue payment
• Credit or debit card
• GCash or Maya
• Pay-at-Hotel options where available

Important notes:

• TomoCoins and TomoPoints cannot be used as booking payment
• Users may earn bonus TomoPoints after QR-confirmed check-in
• Partner venues operate independently of Tomodachi

Tomodachi acts only as a platform facilitator.

7. Nightlife & Social Meetup Policy

Tomodachi may allow users to discover nightlife venues or arrange social meetups.

Users agree that:

• The platform is intended for social interaction only.
• Illegal activities such as prostitution, escort services, or exploitation are strictly prohibited.
• Users must comply with local laws regarding alcohol and venue access.
• Users are responsible for their own safety when meeting others

Tomodachi encourages meeting in public places and exercising caution when interacting with new individuals.

8. Storemadachi Marketplace Policy

Tomodachi may provide a marketplace feature known as Storemadachi.

Through Storemadachi, verified users or partner businesses may list products for sale.

Marketplace rules:

• Sellers must complete identity verification
• Listings must comply with local laws and platform policies
• Prohibited items include illegal goods, counterfeit products, weapons, drugs, and explicit services

Tomodachi reserves the right to remove listings or suspend sellers violating marketplace policies.

Tomodachi does not manufacture or ship products sold by independent sellers.

9. User Generated Content & Community Standards

Tomodachi allows users to upload posts, images, videos, and livestream content.

Users may not post content that is:

• Illegal or fraudulent
• Harassing or abusive
• Threatening or violent
• Misleading or deceptive
• Promoting prohibited services
• Exploiting minors

Tomodachi maintains a zero-tolerance policy for objectionable content and abusive users. Violations will result in content removal and may lead to immediate account termination.

10. Sensitive Content Visibility

Some user-generated content may be labeled as Sensitive Content.

Sensitive content:

• May only be visible to logged-in users
• Must be properly labeled or tagged
• May be restricted based on platform policies

Users can:

• Report objectionable content
• Report abusive users
• Block other users
• Filter certain types of content

Our moderation team reviews reports and aims to act within 24 hours when violations are confirmed.

Actions may include:

• Content removal
• User warnings
• Temporary suspensions
• Permanent account bans

12. Feature Availability

Some Tomodachi features may still be under development and may be released gradually.

These may include:

• Livestream upgrades
• Business dashboards
• Marketplace expansion
• Community event systems

Feature availability may vary depending on updates, region, or platform policies.

13. Disclaimer of Warranties

Tomodachi is provided “as is” without warranties of any kind.

We do not guarantee:

• Specific social outcomes
• Successful matches or friendships
• Business results

Tomodachi acts as a platform connecting users and partner businesses.

14. Limitation of Liability

To the maximum extent permitted by law, A-Tech I.T. Solutions shall not be liable for:

• Indirect or consequential damages
• Disputes between users
• Damages from third-party services
• Loss of user data or content

15. Termination

We reserve the right to suspend or terminate accounts that violate this Agreement.

Reasons may include:

• Fraud or scams
• Abuse of the platform
• Illegal activities
• Violation of community guidelines

Termination may occur without prior notice.

16. Governing Law

This Agreement shall be governed by the laws of the Republic of the Philippines.

Any disputes shall fall under the jurisdiction of Muntinlupa City courts.
