1. Introduction

This End-User License Agreement ("Agreement") governs the installation, access, and use of Tomodachi Social Community App ("Tomodachi" or "App"), operated by A-Tech I.T. Solutions.

By installing or using Tomodachi, users agree to this Agreement, the Terms of Use, Privacy Policy, Community Guidelines, and applicable feature-specific policies.

Tomodachi is intended for individuals aged eighteen (18) years or older.

2. License Grant

A-Tech I.T. Solutions grants users a limited, personal, non-exclusive, non-transferable license to install and use Tomodachi on compatible devices they own or control, subject to applicable app-store usage rules.

Users may not unlawfully copy, modify, redistribute, reverse engineer, or interfere with the application or its security systems.

All rights not expressly granted remain reserved.

3. Intellectual Property

Tomodachi's software, source code, branding, logos, mascots, interface designs, and proprietary technology belong to A-Tech I.T. Solutions or its licensors.

Users retain ownership of their original content, subject to the content license described in the Terms of Use.

4. User Accounts and Identity Verification

Users must provide accurate account information and protect their login credentials.

Tomodachi may require government-issued IDs and selfies for identity verification, fraud prevention, and access to eligible services.

Verification records are handled under the Privacy Policy.

Users may delete their accounts through the application's account-deletion feature or designated website process.

5. In-App Purchases, TomoCoins, and TomoPoints

TomoCoins (TC) are purchased digital credits used for eligible in-app functions, including:

• Reacting to regular-user and TomoCreator posts.
• Sending virtual gifts during live streams.
• Unlocking eligible locked images in messages.

TomoCoins cannot be directly redeemed for cash or GCash vouchers and cannot be used as payment for physical goods, restaurant meals, or accommodation services.

Purchases and refunds are governed by applicable app-store rules and laws.

TomoPoints (TP) are earned through eligible activities and cannot be purchased directly.

Verified users may redeem eligible TomoPoints for available rewards, including GCash vouchers.

The current redemption value is 5,000 TP = ₱250.

Only the redeemed points are deducted. Remaining points continue accumulating in the user's account.

Redemption frequency, limits, eligibility, and anti-fraud procedures are governed by the Tomodachi Redemption Policy.

6. Restaurant and Accommodation Services

TomoHub facilitates restaurant reservations, walk-in interactions, takeaway services, and communication with participating restaurants.

Customers pay partner restaurants directly for food and related services unless otherwise disclosed.

Tomodachi may receive commissions from participating establishments.

TomoStay accommodation services may be introduced or expanded, subject to applicable service-specific conditions.

Participating businesses remain responsible for their independently provided products and services, subject to applicable law.

7. Nightlife and Social Meetups

Users must comply with applicable laws and venue policies.

Illegal activities, exploitation, harassment, and fraudulent arrangements are prohibited.

Users are encouraged to exercise caution when arranging meetings with other individuals.

8. Storemadachi Marketplace

Storemadachi may allow eligible users and participating businesses to list products or conduct marketplace transactions.

Users must provide truthful information and comply with applicable marketplace rules.

Fraudulent listings, counterfeit products, illegal goods, and prohibited services are not permitted.

Additional verification and transaction conditions may apply.

9. User-Generated Content and Copyright

Users may upload permitted photographs, videos, text, and other content.

Users are responsible for having the necessary rights to any copyrighted material included in their uploads.

Tomodachi provides original music for authorized in-app use, subject to applicable usage rights.

Copyright complaints may be submitted through Team Tomodachi inside the application or by emailing atechitsolutions@tomodachi.ph.

Tomodachi may remove or restrict content that infringes intellectual property rights or violates platform policies.

10. Community Standards and Content Moderation

Users must follow Tomodachi's Community Guidelines.

Harassment, scams, impersonation, prohibited content, and fraudulent activities are not permitted.

Tomodachi provides reporting and blocking tools and may review reports or monitored live-stream activity.

Violations may result in content removal, restrictions, suspension, or account termination.

11. Live Streaming and TomoConnect

Live streaming, messaging, and TomoConnect video interactions must comply with platform safety rules.

Unauthorized recording, exploitation, threatening behavior, harassment, or redistribution of private communications without permission is prohibited.

Feature availability may vary by platform and region.

12. Feature Availability and Updates

Tomodachi may modify, improve, suspend, or discontinue features for operational, security, technical, or legal reasons.

Some services may be introduced gradually.

Material changes affecting user rights will be communicated where required by law.

13. Maintenance and Support

A-Tech I.T. Solutions is responsible for maintenance and support of Tomodachi to the extent required by applicable law and this Agreement.

Apple and Google are not responsible for providing maintenance or support for Tomodachi unless otherwise expressly required under their applicable terms.

Users may contact Tomodachi through its official support channels.

14. Disclaimer and Limitation of Liability

Tomodachi is provided subject to applicable law.

To the extent permitted by law, A-Tech I.T. Solutions does not guarantee uninterrupted availability, specific social outcomes, financial earnings, or successful third-party transactions.

Nothing in this Agreement excludes or limits statutory consumer rights, mandatory warranties, or liability that cannot lawfully be excluded.

15. Suspension and Termination

Tomodachi may suspend or terminate accounts for serious policy violations, fraudulent activity, illegal conduct, or threats to platform safety.

Users may request account deletion under the applicable procedures.

Termination does not remove obligations that lawfully survive termination.

16. Governing Law and App Store Terms

This Agreement is governed by the laws of the Republic of the Philippines, subject to mandatory legal protections applicable in other jurisdictions.

This Agreement is between the user and A-Tech I.T. Solutions, not Apple or Google.

Apple and its subsidiaries are third-party beneficiaries of this Agreement with respect to applications distributed through the Apple App Store and may enforce applicable provisions upon the user's acceptance.

A-Tech I.T. Solutions, rather than Apple, is responsible for addressing claims concerning Tomodachi, including product claims, intellectual property complaints, and applicable consumer protection claims, subject to law.

Users must also comply with applicable third-party terms when using Tomodachi.
